1. Purpose of the contract and description of services
iVakeel is a SaaS platform specialized in predictive analytics for legal professionals. It offers intelligent search tools, predictive analysis on case law, risk modeling, and optimization of litigation or transactional strategies. This contract defines the terms of use for the services provided by iVakeel.
2. Registration, access and use
Access to the platform requires prior registration, reserved for legal professionals. The user agrees to provide accurate and up-to-date information, to keep their credentials confidential, and not to transfer or share their access. Any misuse will result in immediate suspension of the account.
3. Pricing conditions and payment terms
The prices are those displayed on the iVakeel website, expressed in euros excluding tax. Payment is made online by credit card or SEPA direct debit. Subscriptions can be monthly or annual, automatically renewable. Invoices are issued electronically and available in the personal area. Any termination must be made via the client area.
4. Obligations and responsibilities of the parties
iVakeel: Provide secure access and optimal availability of the services offered. Ensure the compliance of analytical tools with market technical and legal standards.
User: Use the platform in accordance with professional ethics, not harm its operation, and ensure the security of their access.
5. Personal data protection and confidentiality
iVakeel undertakes to strictly comply with the GDPR and European legislation on data protection. The personal data collected is only used to provide the services and is stored exclusively within the European Union. A Data Protection Officer (DPO) is appointed. Users have the right to access, rectify, object, port, and delete their personal data.
6. Intellectual property
iVakeel retains all intellectual property rights relating to the platform, its content, and the results generated by its analytical and predictive tools. The user only obtains a personal, non-exclusive, and non-transferable license to use the services.
7. Limitation of liability and warranty exclusions
iVakeel does not guarantee the total absence of errors or occasional interruptions. iVakeel's liability is strictly limited to the amount paid by the user for the last 6 months preceding the occurrence of the damage. Any implied warranty regarding the suitability of the services for a particular use is excluded.
8. Security, availability and maintenance
iVakeel applies high IT security standards, including regular audits and tests. The target availability is 99.9% excluding scheduled maintenance. In case of planned interruption, users will be notified at least 72 hours in advance.
9. Technical support and customer service
iVakeel offers technical support by email and chat available Monday to Friday, from 9am to 6pm (Paris time). Support requests will be processed within 24 business hours.
10. Artificial Intelligence and usage limits
iVakeel's AI tools provide predictive analyses and decision support that cannot replace the professional judgment of users. The transparency of results is ensured by the possibility of accessing the analysis criteria that led to each prediction.
11. Force majeure
The parties' liability cannot be engaged in the event of non-performance due to an event constituting force majeure as defined by French case law.
12. Applicable law, competent jurisdiction and disputes
These Terms of Service are governed by French law. Any dispute relating to their interpretation or execution will fall exclusively within the jurisdiction of the Commercial Court of the place of iVakeel's registered office. An attempt at amicable resolution must be made before any legal action.
